These Terms and Conditions consist of the following sections: 1. Introduction; 2. The Purchase Terms; 3. Use of the Website; 4. Products and 5. Miscellaneous, as well as policy, set of terms or document to which a link has been provided herein (collectively “Terms & Conditions”).

1. INTRODUCTION

www.32-stories.com (the"Website") and associated email addresses is operated by or on behalf of 32 Stories Ltd, 10-12 Mulberry Green, Old Harlow, CM17 0ET. If you place an order through Website or via an email link with suffix “@32-stories.com”, upon confirmation that such order is accepted a contract of sale will be executed between you and 32 Stories Limited, United Kingdom, which will be governed by these Terms and Conditions and specifically by the Purchase Terms mentioned below. (hereinafter together referred to as "32 Stories/we/us").

2. PURCHASE TERMS

Please read these Purchase Terms carefully before ordering Products.

2.1 When do these Purchase Terms apply?

These Purchase Terms apply to all offers and contracts relating to the sale and delivery of Products by us. In other words, you agree to these Purchase Terms, when you (i) order anything from 32 Stories, via emails sent to you from 32 Stories, via the Website, via 32 Stories Customer Services, or via 32 Stories Associates (ii) order anything at any web page directly affiliated with the Website, (iii) when you accept an offer from us, or iv) pay for 32 Stories Products via any 3rd party payment processor. It is only possible to deviate from these Purchase Terms if agreed in writing by us. Please note that any purchase or payment terms presented to you in the process of using or signing up for a 32 Stories Services and Product (“Paid Service”) are deemed part of this Agreement.

2.2 Products & Services

We have different types of products and services. This may include the delivery of services which include products fully designed and created by us and custom made based on your individual anatomy.

All Products and Services shown on the Website are subject to availability. This means that, although we strive to ensure our Website reflects the availability of supply, a Service shown on the Website may no longer be available for purchase.

Minor differences in colour and other variations in Products are possible as a result of different image acquisition, display technologies or other technical reasons. 32 Stories is not liable for these variations and deviations. No rights can be derived from typing errors, product descriptions or manifest errors on the Website.

2.3 Requirements to conclude a contract with 32 Stories

You have to be 16 years of age or older to buy Products via the Website.

You can only order on the Website if you are a consumer, not a reseller.

You guarantee that the information you provide to us in the request or order is accurate and complete.

2.4 How is a contract concluded with you?

2.4.1 General Aspects of Contract Formation


The following applies to all types of products or services. All information on the Website is an invitation to treat only. In other words, the information is not an offer or binding contract. You agree that your order is an offer to purchase the Products or Services listed in your order.

All orders submitted by you are subject to acceptance by us. We are entitled to verify an order in advance at all times and/or to refuse to accept an order without providing reasons and with no liability to you or any third parties. If we do not confirm acceptance of your order within ten working days, it is deemed to have been refused.

We may choose not to accept your order at our own discretion. Examples of when we may not accept your order are as follows:

a. If Product(s) are shown on the Website or introduced via a 32S Associate but are not or no longer available;
b. If we are unable to obtain authorisation of your payment;
c. If shipping restrictions apply to a Product or Service;
d. If Product(s) shown on the Website contain a (manifest) error such as being incorrectly priced or otherwise incorrectly described.

In the event that we do not accept(part of) your order we shall be entitled to cancel (part of) your order without incurring any liability towards you or a third party. Following the cancellation we will of course provide you with a refund for the amount paid to us under the cancelled (part of the) order.

We reserve the right to cancel your order after the creation of the contract of sale, thereby terminating the contract of sale, for the reasons stipulated in this section 2.4.1. under headings a through d above. Following the cancellation we will of course provide you with a refund for the amount paid to us under the cancelled (part of the) order.

32 Stories has and fully reserves the right to refuse to accept any order that it knows or reasonably suspects was made with the assistance or involvement of any software, robot, crawler, spider or other automated means or device.

2.4.2 Special Aspects of Contract Formation for Product(s)

After your order has been placed, we will send you an order acknowledgement email with your order number and details of the Product(s) you have offered to purchase and details of any delivery services. Acceptance of your order and the formation of a contract of sale of the Product(s) between you and us will take place once an order is placed; Except where the provisions of section 2.4.1 apply, acceptance of your order and the formation of a contract of sale of Customised Products between you and us will take place when you receive the order confirmation email.

2.5 Retention of title

All Products will remain the property of 32 Stories until you have paid all amounts owed to us in full under any agreement, including the payment of costs, earlier or later deliveries or partial deliveries. You may not sell, dispose of or encumber any Product before full title thereof has passed to you.

2.6 Maintenance of Products

We draw your attention to the washing and maintenance instructions included in the packaging materials of your 32 Stories Products. We are not liable for any damage resulting from incorrect handling of Products, including handling contrary to the instructions.

2.7 Order Cancellation

Please note that special provisions apply to the clear aligner and prescription whitening services which are designed specifically for you. Because your order relates to custom made product(s) or service(s) there is no statutory entitlement to order cancellation. You may cancel your subscription product at any time. Please see Help or FAQ section of the Website for more information.

2.8 Price

The stated prices include VAT if applicable. Prices are quoted in British Pound Sterling (GBP). 32 Stories reserves the right to make price changes prior to an order placed by you.We reserve the right to change, limit or terminate any special offers or discounts at any time.We may charge delivery costs. The delivery costs vary for each Product and type of delivery. For further details, please see section 2.12 or go to the Delivery section of the Website. Any delivery costs may be charged separately, itemised and added to the total amount of the order.

2.9 Methods of payment

Please check the Website for information on available payment methods.

32 Stories reserves the right to conduct an individual credit check for each order in accordance with the 32 Stories Privacy Policy. Depending on the results of this check, 32 Stories reserves the right to refuse certain methods of payment.

We may use a third-party payment processor (the "Payment Processor") to bill you through a payment account linked to your Account on the Services (your "Billing Account") for use of the 32 Stories Products. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to this Agreement.

By choosing to use 32 Stories Products, you agree to pay us, through the Payment Processor, all charges at the prices indicated on the order pages when you placed your order for any use of such Paid Products in accordance with the applicable payment terms and you authorise us, through the Payment Processor, to charge your chosen payment provider (your "Payment Method").

You agree to make payments using that selected Payment Method. We use reasonable care to ensure that the prices advised to you are correct.  However, we reserve the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

If the rate of VAT is applicable and changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. If we, through the Payment Processor, do not receive payment from you by the due date we may charge interest to you on the overdue amount at the rate of 3% a year above the base lending rate of Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgement. You must pay us interest together with any overdue amount.

RECURRING BILLING: Some of the Paid Products, such as the purchase of custom-made aligners or other products, may consist of an initial period, for which there is a one-time charge, followed by recurring period charges as agreed to by you. By choosing an installment payment plan, you acknowledge that such Products have an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. All recurring payments are fully earned upon payment.

YOU MUST PROMPTLY UPDATE ALL INFORMATION TO KEEP YOUR BILLING ACCOUNT CURRENT, COMPLETE AND ACCURATE (SUCH AS A CHANGE IN BILLING ADDRESS, CREDIT CARD NUMBER, OR CREDIT CARD EXPIRATION DATE), AND YOU MUST PROMPTLY NOTIFY US OR OUR PAYMENT PROCESSOR IF YOUR PAYMENT METHOD IS CANCELLED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORISED DISCLOSURE OR USE OF ANY USER NAME OR PASSWORD. IF YOU FAIL TO PROVIDE ANY OF THE FOREGOING INFORMATION,WE MAY INADVERTENTLY CONTINUE CHARGING YOU FOR ANY USE OF PAID SERVICES UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE TERMINATED YOUR PAID SERVICES AS SET FORTH ABOVE. CHANGE IN AMOUNT AUTHORISED.

If the amount to be charged to your Billing Account varies from the amount you pre-authorised (other than due to the imposition or change in the amount of duty and taxes), you have the right to receive, and we shall provide, notice of the amount to be charged and the date of the charge before the scheduled date of the transaction. Any agreement you have with your payment provider will govern your use of your Payment Method. You agree that we may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle.

Auto-renewal for Subscription Services

You have signed up for successive renewal periods of the same duration as the installment payment term originally selected, at the then-current non-promotional rate. All fees related to installment payment are fully earned upon payment.

Reaffirmation of Authorisation

Your continued use of installment payment reaffirms that we are authorised to charge your Payment Method for that Paid Service. We may submit those charges for payment and you will be responsible for such charges. This does not waive our right to seek payment directly from you. Your charges may be payable in advance, in arrears,per usage, or as otherwise described when you initially selected to use the Paid Service.

2.10 Invoicing

Where we elect, or are required by applicable law, to issue or make available an invoice, we reserve the right to issue or make available electronic invoices and you agree to such form of invoicing.

2.11 Special aspects of Personalised Products

We may at times, electively, permit you to further personalise your Customised Product and make it personal whereby you can add your own text. You can add your name, or be as creative as you like. Please keep it decent. We reserve the right to remove inappropriate language and use of brand names. Also keep in mind that some special characters are not supported by our system.

We kindly request you not to use, upload, submit,copy or otherwise make public any names, words or phrases which:
1. consist of or contain the name of a product,service, company, organisation or event which belongs to someone else;
2. consist of or contain the name or nickname of a famous person (living or dead);
3. infringe or may infringe third party trademarks or other intellectual property rights;
4. are threatening, incite violence, are defamatory, obscene, discriminatory, inflammatory, sexually explicit or otherwise unlawful; and/or
5. are otherwise unacceptable to 32 stories in its sole discretion.

32 Stories reserves the right to reject any personalisation, names, words or phrases (or combinations thereof) which fall into any of the above categories. This will result in your order being cancelled. Further, 32 Stories will be entitled to claim compensation equal to the value of the Products ordered.

Note that by placing your order for your personalised Customised Products, you:
a. represent and guarantee that any names, words or phrases you use, upload, submit, copy or otherwise make public for use on your personalised Product do not fall into any of the above categories;
b. agree to indemnify 32 Stories and its affiliated companies and keep 32 Stories and its affiliated companies indemnified against all costs, expenses, damages, losses and liabilities incurred or suffered by 32 Stories or its affiliated companies as a result of the use of any names, words or phrases used, uploaded, submitted, copied or otherwise made public by you (including use on your personalised Product);
c. grant to 32 Stories and its affiliated companies a non-exclusive, irrevocable, royalty-free, worldwide, fully sub-licensable right to use, reproduce, disclose and modify the names, words or phrases submitted by you for the purposes of fulfilling your order; and/or
d. insofar as the order involves personalised Products you will not have any cooling-off period, right of revocation, right of return or right of withdrawal.

2.12 Delivery

We will deliver to the address indicated by you within the UK mainland. We can only deliver to a home or office address or a carrier pickup location or if you have chosen to collect the Products from a retail location indicated by the shipping company, to the address of the relevant store. We, or the 3rd party shipping carrier, will confirm this to you by an email when informing you that the Products are ready for you to pick up. If a delivery attempt is unsuccessful, you agree that the carrier we have engaged for the delivery may also deliver the Products to a neighbouring/nearby address or pick-up point, after which 32 Stories is deemed to have met its obligation to deliver the Products. The carrier will notify you of the delivery to the neighbouring/nearby address or pick-up point.

Shipment of orders will take place on business days, not being a public holiday in the area in which our warehouse is located. Therefore, please, take into account any public holidays including any national and/or regional holidays in your country of residence. Deliveries will be made on business days, not being a public holiday in your country. Note that public holidays may vary per country and per year.

For detailed information about delivery periods, please check the specifications for the different types of delivery on the Delivery section of our Website. Delivery periods are indicative and are therefore not regarded as strict deadlines. The mere fact that a delivery period is exceeded does not entitle you to compensation.

Notwithstanding this, in case of the unlikely event of delay in an Express delivery, we may, at our discretion,refund to you the full cost of Express delivery. Note that Customised Product shave different, and generally longer, delivery periods. This means that your complete order of Standard Products and Customised Products will take longer to deliver.

If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

32 Stories is entitled, insofar as reasonably possible, to make split deliveries so that you receive your Products as soon as possible. There are no additional costs associated with such split deliveries. However, in the event that you request that we deliver in parts, we may charge you for extra delivery costs. Each split order shall constitute a separate contract of sale. If we are late delivering a part or one split order is faulty, that will not entitle you to cancel any other part of split order.

In the unlikely event that after entering into the contract of sale, we cannot, could not or can no longer deliver (part of) your order and are not responsible for this situation, we will be entitled to terminate the contract of sale.

We will, of course, inform you as soon as reasonably practicable and reimburse any payments made.

2.13 Returns and Withdrawal Policy

For practical information and the information regarding returns please see the Return section of the Website.

In the event that you have a right to withdraw from a contract of sale with us (and thus return your Product(s)), the following conditions apply.

Notification of Withdrawal and Return of Products

Please note that special provisions apply for Customised or Custom made Products as these have been designed specifically for you. This means that (without this affecting your statutory rights) we cannot accept returns of these under the Voluntary Returns Guarantee, unless they have manufacturing defects.

If you return your Products because they are faulty, we shall bear the costs of returning the Products. In some cases you can request the carrier pick up the parcel for return but this may result in an extra cost charged to you by the carrier. Returns not made in accordance with the instructions set forth above shall be at your own risk and at your expense.

To exercise a statutory right of return for standard products ie. which are non-customised, you must inform us (32 Stories (UK) Limited, c/o 32 Stories Customer Service) submitting a clear declaration (e.g. a letter sent by post, a fax or an email) stating your decision to withdraw from the contract of sale. To meet the withdrawal period deadlines specified in Sections 2.14 and 2.15 you will need to notify us about the fact that you are exercising your right of withdrawal before the expiry of the relevant withdrawal period.

You must send back or submit the Products immediately once a notice of a decision to return is made, in accordance with the Returns and Withdrawal Policy herein and according to the relevant section on the website and in suitable packaging.

We shall notify you via email once we have received and processed the returned Product(s).

2.14 Statutory Right of Withdrawal

Consumers typically have the right to withdraw from a contract within fourteen (14) days without giving any reason, however, note that this statutory right does not apply to custom made or customised products.

If you withdraw from a contract of sale for a standard product within the designated time period, and in accordance with our Returns Policy (Section 2.13) and this Section 2.14, we shall reimburse all payments we received from you, including delivery charges (provided the returned Product(s) represent(s) the complete order and with the exception of any additional charges arising from the fact that you chose a different method of delivery to the cheapest standard delivery offered by us, where available), at the latest within fourteen (14) days from the date on which the notification of withdrawal of this contract has been received by us. For this repayment we shall use the same method of payment that you used making the original transaction, unless we arrange a different method with you; you will not be charged any fees for such repayments under any circumstances. We may withhold reimbursement until we have received the returned Products, or until you have submitted proof that you have returned the Products, whichever comes earlier.

You only have to pay for any diminished value of Products if this diminished value is due to improper handling on your behalf while ascertaining the nature, characteristics and functioning of the Products.

Exceptions to your right of withdrawal

You do not have a right of withdrawal,whether pursuant to Section 2.14 or Section 2.15, for contracts regarding the:
delivery of products that are made to your own specifications or which are clearly tailored to your personal needs (Customised Products); and/or
delivery of Products which are not suitable to be returned for health or hygiene reasons and where a seal was removed after delivery.


2.15 Voluntary Return Guarantee inaddition to your Statutory Right of Withdrawal

In certain instances, where explicitly mentioned or highlighted, and entirely at our discretion, and without prejudice to your right of withdrawal pursuant to Section 2.14 (and any other applicable statutory rights), we may grant you an additional Voluntary Return Guarantee. This allows you to withdraw from the contract of sale, without specifying any reasons, for an additional specified number of days beyond the Withdrawal Period, so a longer total return period (“Voluntary Return Period”), as a contractual right of withdrawal with respect to a Standard Product may apply.

Please note that the Voluntary Return Period does not apply to Product(s) unless explicitly stated.

We offer this Voluntary Return Guarantee during the Voluntary Return Period subject to the provisions of our Returns and Withdrawal Policy (Section 2.13) and the following conditions.

The Product(s) must have not been used or damaged beyond normal inspection use and must be returned inits original packaging (none of the aforementioned affect your legal statutory rights as described above, in particular your right of withdrawal pursuant to Section 2.14).

We must be in receipt of the Product(s)you are returning prior to the end of the Voluntary Return Period.

We reserve the right to reject the return and shall not give any compensation under this Voluntary Return Guarantee for returned Standard Products that do not comply with these conditions.

If you withdraw from a contract of sale during the Voluntary Return Period, in accordance with our Returns Policy(Section 2.13) and this Section 2.15, we will reimburse all payments we received from you, including delivery charges (provided the returned Standard Product(s) represent(s) the complete order and with the exception of any additional charges arising from the fact that you chose a different method of delivery to the cheapest standard delivery offered by us, where available)within fourteen (14) days after our receipt of the Standard Product(s). For this repayment we shall use the same method of payment that you used making the original transaction and you will not be charged any fees for such repayments under any circumstances.

2.16 Returns related to Customised or Custom made Products

As explained in section 2.13, since Customised Products are created just for you, we do not accept returns of Customised or custom made Products except in the case of manufacturing defects. If your Customised Product has a defect please contact us for return instructions.

2.17 Exchange policy

We do not offer any exchange of yourProduct (“Original Product”) for another Product (“New Product”).


2.18 Damaged or defective Products

For 32 Stories, quality is paramount. All of our products are approved by the relevant regulators and we thoroughly test all our Products to ensure they are of the highest level of quality and safety. It is extremely rare for our Products to be damaged or defective. 32 Stories has a legal obligation to make sure that our Products are conform to the contract of sale.

Returned Products are inspected by the 32 Stories Quality Assurance Department and if the damage is the result of a manufacturing defect or deviation from factory specifications, 32 Stories will undertake to, at 32 Stories’ option, (a) in the case of goods, the prompt replacement of the goods or the supply of equivalent goods, or the cost of replacing the goods or of acquiring equivalent goods; and (b), in the case of Services, the supplying of the Services again.

It is incredibly unlikely that all of the aligners would be defective, therefore where a particular aligner tray is identified as being faulty, please contact us promptly, noting the tray number which appears faulty (if this relates to an aligner tray), to discuss the replacement of the defective tray. If you identify a defective tray we will provide you with a replacement at no extra cost to you.

If we suggest you return the products, the easiest and our preferred way to return your products is to follow the steps in the Return section of the Website, or by submitting the appendix at the end of this document below. Please contact our customer services team initially who can help you with next steps.

If the problem was caused by reasons other than materials quality or assembly process, the original Product is returned to you. We do not refund Products:
• obtained from a source other than the Website;
• that have been damaged by abuse or negligence (e.g. exposure to chemicals, caustic substances, open flame, high heat, sharp object, etc.); and/or
• that have been damaged by misuse or activities other than the intended purpose (e.g. use of aligners for whitening trays, or whitening trays used as aligners).

Please note the life expectancy of any Product depends on the individual using the Product, the conditions of use, and the characteristic wear patterns of the user. Our Products damaged by normal wear and tear or that have exceeded the reasonable lifespan of the Product are not replaced.

2.19 The recommended treatment plan is not working

Because orthodontics is a complicated medical process which involves making a change to your biomechanics, we cannot predict with 100% certainty how your body will respond and therefore in a small number of cases, the treatment may need to be reviewed during the process due a tray no longer fitting as prescribed. If this occurs you should continue to wear the last tray that fits (unless this is causing you unbearable pain) and contact us urgently at [email protected] where we will direct you on how to proceed. This may involve taking an impression and providing a new treatment plan with complete aligner set. Provided the 32 Stories clinical staff feel it is clinically advisable to continue, we will develop a new treatment plan for you and provide you with a replacement product without any additional charges.

2.20 Gift Cards

Gift cards can only be used in connection with Services offered by 32 Stories, are not replaceable if lost or stolen and have no expiration date. Gift cards have no cash value and cannot be exchanged for cash except as required by law. Gift Cards must be entered directly into the Client account or via the payment link received by email; they may not be directly accepted by Associates or Affiliated dentists as a payment method.

A Gift Card cannot be combined with any other Gift Cards, gift certificates or Promo Codes. No credit card, credit line, overdraft protection, or deposit account is associated with your Gift Card. You cannot “reload” (or add value/balance) to your Gift Card at this time. If a Gift Card holder’s purchase exceeds the amount of that Gift Card’s balance, the Gift Card holder must pay the difference by another means. Unused Gift Card balances are not transferable. 32 Stories reserves the right to correct the balance of a Gift Card if 32 Stories believes that a billing error has occurred. 32 Stories reserves the right to limit quantities of Gift Cards purchased by any person or entity, and to cancel a Gift Card if it believes that the Gift Card was obtained through fraudulent or unauthorised means. Gift Cards and their use are subject to this Agreement, and use of a Gift Card constitutes acceptance thereof.

You agree to comply with all Gift Card terms and conditions.

3. USE OF THE WEBSITE

Please read these Terms and Conditions for website use (“Use of the Website Terms and Conditions”) carefully before using the Website and any 32 Stories content on social media websites, including without limit Facebook and Twitter (together: the “Website”). These Use of the Website Terms and Conditions apply to all visits and uses of the Website, as well as to the Content (as defined below), information, recommendations, products and services provided to you on or through the Website. By accessing and using the Website, you grant your consent to these Use of the Website Terms and Conditions in their entirety in addition to any other law or regulation that applies to the Website and the Internet. If you do not agree to these Use of the Website Terms and Conditions, please leave the Website immediately.

3.1 Content on the Website

All of the content featured or displayed on the Website, including, but not limited to, logos, icons,navigational buttons, trademarks, text, graphics, photographs, images, moving images, sound, illustrations and software (“Content”), is owned by 32 Stories Ltd, its affiliated companies, its licensors or its content providers. All elements of the Website including, but not limited to, the general design and the Content, can be protected by copyright, moral rights, database rights,trade mark and other laws relating to intellectual property rights. Except as explicitly permitted under this or another agreement with 32 Stories, no portion or element of the Website or its Content may be copied or retransmitted via any means. The Website, its Content and all related rights shall remain the exclusive property of 32 Stories, its affiliated companies or its licensors unless otherwise expressly agreed. All such rights are reserved.

3.2 Copyright and trademarks

The copyright in all Content is and remains owned by 32 Stories, its affiliated companies or its licensors as appropriate. Except as may be otherwise indicated in specific documents within the Website, you are authorised to view, play, print and download Content found on the Website for personal, informational, and non-commercial purposes only.You may not modify any of the materials and you may not copy, distribute,transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any Content. You may not reuse any Content without first obtaining the consent of 32 Stories. For purposes of these terms, the use of any such Content on any other Website or networked computer environment is prohibited. You will not remove any copyright, trademark or other proprietary notices from Content found on the Website. In the event you download software(including but not limited to screensavers, smart phone applications, icons,videos and wallpapers) from the Website, the software, including any files,images incorporated in or generated by the software, and data accompanying the software (collectively, the “Software”) are licensed to you by 32 Stories. 32 Stories does not transfer title to the Software to you. You own the medium on which the Software is recorded, but 32 Stories retains full and complete title to the Software, and all intellectual property rights therein. You may not redistribute, sell, decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-readable form. 4.2 Warranty

32 Stories warrants that its products:
shall conform to the specifications represented in the treatment plan approved by the dental & lab team; and are free from defects in material and workmanship.

4.3 Subject to Clause 5.12, 32 Stories shall not be liable

for any defects that are caused by neglect, misuse, or mistreatment of its products by the patient or any third party not instructed by 32 Stories;

for any defects that are caused by failure to follow directions including (but not limited to) wearing aligners out of sequence, not wearing aligners for the entire duration of the specified wear schedule, not providing photo updates, or wearing aligners for less than 22 hours per day;

for any products being used in combination with other third party products or by failure to adhere to the Patient Guidelines unless explicitly instructed to do so by 32 Stories; or

if you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity, as we only supply the products only for domestic and private use.

If we fail to comply with these terms,we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill,but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

32 Stories reserves the right to sub-contract, transfer, assign or novate all or any of our rights and obligations under 32 Stories terms and conditions provided that your rights under 32 Stories terms and conditions are not affected. You may not sub-contract, assign or otherwise transfer any of your rights or obligations under the 32 Stories terms and conditions without our consent in writing.

5.7 Events beyond reasonable control

32 Stories will be not held responsible for any delay or failure to perform or comply with our obligations under the 32 Stories terms and conditions when the delay or failure arises from any cause which is beyond 32 Stories’ reasonable control.

5.8 Applicable law and jurisdiction

The 32 Stories Terms and Conditions shall be governed by the laws of England & Wales. English law applies to the sales contract, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). This does not affect the applicable mandatory rights under the law of your country of residence. You may bring any dispute which may arise under these Terms and Conditions to – at your discretion - a competent court of England – with the exclusion of any other court - competent to settle any of such a dispute. 32 Stories shall bring any dispute which may arise under these Terms and Conditions to the competent court of England. 5.9 Suspension or termination of Use

Your failure to follow the requirements of this Agreement may result in suspension or termination of your access to the Product services, without notice, in addition to 32 Stories' other remedies.

32 Stories further reserves the right to terminate, without notice, any user upon user’s breach of this Agreement. Where possible 32 Stories will provide you with notice before such suspension and/or termination and an explanation of why 32 Stories suspended and/or terminated the Agreement and/or access to the Website. You will have a right to respond to such suspension and/or termination by contacting [email protected] You can also terminate this Agreement at any time on payment of any outstanding amounts. You can also stop using the Services and exit the Website at any time.

We may also terminate your access to all or any part of the Product services at any time if:
a. you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products
b. we do not receive a response from you within 90 days of us sending your Impression to the lab, as we will assume that you have decided to not move to the next step of the 32 Stories journey but we will send you a reminder before terminating just in case you have forgotten about us
c. we are unable to provide you treatment due to medical concerns, as advised by a 32 Stories approved dentist
d. you do not, within a reasonable time, allow us to deliver the products to you or collect them from us; ore. you do not make any payment to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due

If you wish to terminate your installment payment plan, you may do so by contacting customer service. Any fees paid hereunder are non-refundable as our aligners are made to your individual specifications and are therefore a customised product.

5.10 Text messaging and Phone Calls

We, a 32 Stories representative, a 32 Stories Associate or an affiliated Dentist or dental practice may contact you by telephone or text messages (including by an automatic telephone dialling system) at any of the phone numbers provided by you or on your behalf in connection with 32 Stories, including for marketing purposes. You understand that you are not required to provide this consent as a condition of purchasing any property, goods or services. You also understand that you may opt out of receiving text messages from 32 Stories at any time, either by texting the word "STOP" using the mobile device that is receiving the messages, or by contacting customer support. If you do not choose to opt out, 32 Stories may contact you as outlined in its User Privacy Policy, located on the website

5.11 SMS Short Code Terms &Conditions

If you consent to provide your mobile phone number to 32 Stories, we may use this information to send you transactional SMS updates about your requests, orders and other feedback. We may also share this information with a third party to aid in sending text messages via SMS or SMS short codes. Number and size of messages will vary per user based on evaluation/treatment length and stages. Reply 'STOP' to any SMS message to unsubscribe from updates. Reply 'HELP' to get help. 32 Stories does not charge any users fees to send or receive text messages. However, message and data rates may apply from your mobile carrier and you should contact your mobile carrier to understand what message and data rates may apply. The wireless carriers are not liable for delayed or undelivered message. 32 Stories will not be liable for any delays in the receipt of any SMS messages connected with our SMS Gateway. Delivery of SMS messages is subject to effective transmission from your wireless service provider/network operator. 32 Stories respects your privacy. We will only use the information you provide to transmit text messages to you. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, to protect our rights or property.Text messages through your wireless carrier/service provider are not secure messages through encryption or similar technology, and therefore you should take care to include only the content you wish to share in the texts to our Customer Support agents. 32 Stories respects your right to privacy. 5.13 Liability

Nothing in these Terms or in the pages of the website shall limit our liability for death or personal injury arising from our negligence, or for fraud, or for misrepresentation as to a fundamental matter, which cannot be excluded or limited under applicable law.

5.14 Duration of treatment

We would typically expect your use of your aligners to last between 6 and 9 months. However, individual result vary and our team of dentists and specialists may advise a longer or shorter treatment process in their prescription. Your whitening prescription will also specify the duration of treatment, but this is usually around 10 days.

5.15 Non-Urgent Clinical Queries

5.16 Non-UK customers

6. POSSIBLE RISKS OF TELEDENTISTRY

As with any medical or dental procedure, there are potential risks associated with the use of Teledentistry. 32Stories believes that the likelihood of these risks materializing is very low.
These risks may include, without limitation, the following:
- Delays in medical evaluation and consultation or treatment may occur due to deficiencies or failures of the equipment which may include poor video and data quality.
- Security protocols could fail, causing a breach of privacy of personal medical information.
- Lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other negative outcomes.

By accepting these Terms of Use, you acknowledge that you understand and agree with the following:
-You understand that the laws that protect privacy and the confidentiality of medical information also apply to teledentistry. Links are provided above to the 32 Stories Privacy Notice which explains this in greater detail.
- You understand that teledentistry may involve electronic communication of your personal medical information to medical or dental practitioners who may be located in other areas and other clinical settings.
- You understand that you may expect the anticipated benefits from the use of teledentistry, but that no results can be guaranteed or assured.
- You understand that all information will be part of your medical record and available to you by requesting the summary from the visit. This information will have the same restrictions on dissemination without your consent.
- You understand that all medical and dental advice and treatment is the responsibility of the treating clinician. 32 Stories is not liable for any medical advice or treatment provided by clinicians using its service.
- Except to the extent already relied upon, you understand you may withdraw your consent at any time by emailing [email protected] to withdraw your consent and inactivate your account.
You understand that your healthcare information may be shared with other individuals for treatment, payment and healthcare operations purposes.

You further understand that your healthcare information may be shared in the following circumstances:
- When a valid court order is issued for medical records.
- Reporting suspected abuse, neglect, or domestic violence.
- Preventing or reducing a serious threat to anyone's health or safety.

7. PATIENT CONSENT TO THE USE OF TELEDENTISTRY

I have read and understand the information provided above, and understand the risks and benefits of teledentistry, and by accepting these terms of use I hereby give my informed consent to participate in a teledentistry visit under the terms described herein. The scope of care will be at the sole discretion of the dentist who is treating you, with no guarantee of diagnosis, treatment, or prescription. The healthcare physician will determine whether or not the condition being diagnosed and/or treated is appropriate for a telehealth encounter.

How do aligners work?

We will create a highly accurate virtual model of you mouth using the dental impression you will take with your dental impression. 

Our orthodontists and dentists will prescribe a detailed treatment plan, specifying exact tooth movements to create your ideal smile. 

We will then custom make a series of aligners designed to alter the position of your teeth over a series of months. 

You will change your aligners every 1-2 weeks, as specified by your treatment plan. By your last aligner your teeth will be in their final position, giving you the smile you are looking for

What is a 32S Associate?

32S Associates are local health, beauty and wellness professionals trained in association with the British Dental Aligner Society in how to take the perfect impressions. They are based local to you, and can help you get your dental impression done quickly and conveniently, and take you through the initial consent process. Once this is done you will be seen by one of our dental team through a video consultation, exactly as you would be in a dentist's surgery.

What are the aligners made of?

The aligners are printed using the most accurate 3D printing methods, using the newest BPA-free materials. These are completely clear and pretty much invisible. Most importantly, they don't cause pain and irritation like other types of braces do.

What happens if I lose an aligner?

Your aligners are custom made for you, and can be remade if you lose one. If this happens, let us know immediately which aligner you've lost, and keep wearing the most recent aligner you have until your replacements arrive (additional cost may be incurred)

Is everyone suitable for 32Stories aligners?

The very simple answer is no, and we will be completely honest with you. Our dental team do not cut corners, and are committed to results which last a lifetime. If your case is complex you may require additional treatments to avoid relapse and complications, and we will explain this in detail to you.

What happens if my case is complex?

If your case is particularly complex we will know this once we've reviewed the 3D model of your teeth. We will explain why your case is complicated over a video consultation and give you the option to have additional procedures, such as IPR or attachments, with a partner orthodontist, with no obligation to you.

What is IPR?

Inter-proximal reduction is an important part of orthodontics for some patients, as it allows space to be created. While aligners can expand your dental arch, it can't always make enough space. IPR involves shaving the sides of teeth by a fraction of a millimeter, which is invisible to the eye, but makes it much easier for your teeth to move.

Many providers simply offer aligners to patients who actually need IPR. The results is that these patients' teeth quickly relapse, wasting the time and effort spent straightening them!

Do you offer IPR?

We partner with local dentists in your area, and we'll provide you with their details, with no obligation, and we will let you know the cost of this treatment beforehand so that you can make a fully informed decision If you decide to go ahead with treatment we can share all of your details with them, including, your 3D model and the detailed description of what level of IPR is needed and on which teeth. What are attachments?

Attachments are small white 'bumps' which are attached to teeth using special dental glue. When aligners are placed over the top of these they can allow extra pressure to be applied, to force certain types of movement, particularly rotation. Sometimes you will not get perfectly straight teeth without these.

What do I do if I have questions, or there is a problem?

Our customer support is available 7 days a week for any queries. We can arrange for you to have a video consultation with a dentist too, if this is needed. Your local 32S Associate is also an excellent source of advice and support!

What happens if I have implants, or other existing dental issues?

Safety is our primary concern. Our dentists will discuss your dental history with you during your consultation. If they feel you are not suitable for aligners or whitening for whatever reason, they will inform you of this. Depending on your risk factors, they may also suggest you go for an Xray prior to commencing treatment, and they will put you in touch with local 32S partners who can do this for you.

Can I speed up my aligners?

Your treatment plan is carefully designed and prescribed by a specialist in tooth movement, just for your teeth. They will specify how long each aligner should be warn for and we strongly recommend that patients do not deviate from this plan to avoid complications

Do you offer discounts?

In healthcare we believe you should not cut corners and so we do not offer discounts. Our fixed prices reflect the consistently high quality of our products and services.

What is the difference between using 32S and getting braces from a dentist or orthodontist in a surgery?
